11 maltatoday | SUNDAY • 22 SEPTEMBER 2019 opt to conscientiously ob- ject to dispensing the morn- ing-after pill. Nonetheless, Bonello said the problems arising from conscientious objections are resolved differently in dif- ferent countries. The former judge ex- plained that there seemed to be no standard solution which applied to all cases and in all circumstances. Bonello gave the example of two British cases brought to the European court of hu- man rights by adherents of the Sikh culture and religion – within ancient tradition, a Sikh male can never cut his hair and must wear a dagger, so when compulsory crash helmets were introduced for motorcyclists, some tradi- tionalist Sikhs challenged this imposition because the new law would oblige them to cut their hair. Another separate issue was the wear- ing of 'religious' daggers in public. "The Strasbourg Court de- cided that forcing a Sikh to cut his hair would be a dis- proportionate invasion of his freedom of conscience. But the prohibition of car- rying a dagger in public was necessary for ensuring the higher value of preventing crime," Bonello said. Control of the bank passed under a third party 'competent person' when the FBI arrested owner Ali Sadr Hasheminejad at Dulles airport. Although the US charges are on actions that predate the 2014 licence granted to Pilatus, the MFSA removed Hasheminejad from chairman of the bank. While Hasheminejad awaits trial in a New York court, Pilatus Bank's owners and directors are still contesting the MFSA's decision to shut down the bank. Hasheminejad's arrest im- mediately pushed the MFSA to put the bank under con- trollership, but officials inside the regulator had also said the decision was rushed and 'political', in a bid to counter the public impression that the MFSA had licensed a prob- lematic bank. Since the publication of the Egrant inquiry conclusions, the bank has been on the of- fensive against its detractors, after the allegation by the late journalist Daphne Caruana Galizia that the bank had pro- cessed a $1 million transac- tion from the Azerbaijani ruling dynasty to Joseph Mus- cat's spouse turned out to be untrue. Pilatus protested the ap- pointment of American bank- ing veteran Lawrence Connell as controller, whom it said cost "a potential USD600,000 (€523,000) per annum" in re- muneration fees alone, apart from the remuneration of ad- ditional staff and advisors en- gaged by Connell. The bank claimed it is incurring ex- penses of $100,000 (€87,000) a month. Hasheminejad – a natural- ised US national – is charged in a New York district court of having evaded US sanc- tions against Iran, apart from committing bank fraud, by funnelling over $115 million in payments for a Venezuelan housing complex through the US financial system for the benefit of his Iranian family's companies. To justify its decision to put the bank under controller- ship, the MFSA said the arrest raised reasonable doubt about the integrity and suitability of Hasheminejad to fulfil his du- ties. Hasheminejad was granted bail in the United States but has restricted travel and elec- tronic monitoring. Pilatus also accused its former employee turned whistleblower Maria Efimova – sacked after three months and later charged by Maltese police of misappropriating funds from the bank – of be- ing a 'Russian informant' who fed misrepresentations of the bank to politically-motivated collaborators. Efimova was first held up as Daphne Caruana Galizia's primary source on the Egrant allegation; but Efimova later denied being Caruana Gali- zia's main source, saying she only confirmed allegations that the journalist was already working on. The Egrant inquiry's conclu- sions said Efimova gave con- tradictory accounts that dis- credited her status as a lauded whistleblower, after Magis- trate Aaron Bugeja said the Egrant allegation was based on fabricated documents.
