Chloe Portelli hoped her status as a registered farmer, just like her father, would carry the day but Portelli is actually a hospi- tality manager for the Portelli Group's hotel chain and is di- rectly responsible for the oper- ations and project management of these properties. The application was recom- mended for approval by the case officer, but the PA's planning commission decided to post- pone its decision and consider the approval of the new store together with an application to sanction illegal rubble walls. The 20sq.m store was pro- posed on some 22,000sq.m of agricultural land on a site where the PA recently issued an en- forcement order against illegal works, specifically over new rub- ble walls that did not previously exist on the site. Residents had been complaining of these works for months before PA officials intervened. The area is a continuous stretch of open terraced land known as il-Gebel l-Ahmar on the south- ern countryside of Nadur, facing the village of Ghajnsielem, and is highly visible from various sur- rounding areas. The Gozo and Comino Local plan shows the area designated as an Area of High Landscape Sensitivity. The Environment and Re- sources Authority had warned that the environmentally-incon- siderate works had defaced rural landscape, and warned against "visual intrusion" and a "signifi- cant cumulative impact" on the surrounding rural environment. The ERA said that if approved the development would end up "breaking a presently un- disturbed skyline" and create a precedent for similar changes in the surrounding lands. It insist- ed that any interventions should have been limited to "surgical re- pairs to limited stretches of rub- ble wall that are in bad shape". But the case officer dismissed ERA's concerns on the new store, arguing that the proposed agricultural store was compliant with the Rural Policy and Design Guidelines. The Agricultural Advisory Committee originally objected to the new store because the site was registered on a third party and because 40% of the holding was not cultivated. The objec- tion was dropped once the hold- ing started being cultivated and determining that Portelli was an "active arable farmer." Portelli submitted proof of be- ing a famer "in the form of pho- tographic evidence showing site is being cultivated and planted with trees and agricultural re- ceipts pertaining to her."
