The Malta Foreign Direct Investment Screening Office, set up in order to implement the provisions
of Regulation (EU) 2019/452, would like to notify Corporate Service Providers, that henceforth, the
Office shall receive notification forms from third country investors in line with the above Regulation.
This notification form is to be filled only;
a) where the Ultimate Beneficial Owner, whether existing or new, is a 'foreign investor' as defined in
Article 2 of the Regulation and is an individual who has a direct or indirect economic ownership
and/or voting rights of 10 % or more, or control by other means;
b) the activity is one as described in Article 4 of the Regulation cited above;
c) where there is a direct, tangible and long-lasting nature within the territory of Malta
Where the conditions specified in (a) to (c) above subsist cumulatively, this notification form is to be
completed and submitted to the Office BEFORE the relevant documents are submitted to the Malta
Business Registry.
