GAETANA AQUILINA For Registrar of Courts and Civil Tribunals By means of a decree given, by the Civil Court ( Family Section) on the 15th May 2021, in the records of the 861 use cash and paper-based pay- ment instruments as the pri- mary payment channel. The love for cash, according to the reasons given by survey participants, is based on the premise that cash is easy and fast to use, and helps avoid fraud and theft. The reasons are incompre- hensible since it is universally accepted that fraud is more likely with cash as a result of counterfeit notes and is also very attractive to theft. But on a more sinister level, cash is the preferred choice of payment where its provenance is from illicit activities. Paying in cash for luxury and expen- sive items is one way of laun- dering money because it can- not be traced. Tighter screws on dirty money The new regulations intro- duced five months ago seek to tighten the screws on this ave- nue of cleaning up dirty mon- ey. The rules place the onus on both the seller and the buyer. They also define what linked transactions are to prevent multiple small payments that fall below the threshold for the same object. Two or more cash transac- tions which are performed by the same parties, having the same or similar linked purpose or purposes, and which are carried out within a period of six months are considered to be linked and fall within the scope of the prohibition. An FAQ released last week by the Financial Intelligence Analysis Unit explains that it is possible for someone to buy a second-hand vehicle for a val- ue of less than €10,000 using cash. But, if within six months, the same person buys a second car of similar value from the same trader, the two transac- tions will be considered linked and the penalties applied ac- cordingly if cash is used the second time around. The FIAU says that if the pur- chasers are not the same per- son, then the transactions are not deemed to be linked. But in those instances when a buy- er is carrying out a transaction on behalf of someone else, the transactions will still be linked. The FIAU lists the following example: If Person A buys a ve- hicle from Trader B in March 2021 and three months later, Person C buys a vehicle from the same Trader B, but regis- ters the vehicle under Person A, the transactions are con- sidered to be linked and any amount paid in cash above the €10,000 limit will fall foul of the law and incur a penalty. The cash restrictions ap- ply for any currency that can be used to trade in the listed items and the threshold will be equivalent to €10,000. The regulations do not apply when depositing or withdraw- ing cash from a bank. Criminal proceedings for offences against these regu- lations shall be barred after a lapse of five years. ksansone@mediatoday.com.mt JAMES DEBONO THE CEO of the Hugo's hospi- tality and food chain is appeal- ing a second refusal to an illegal burger kiosk on the Tal-Barra- ni road in Għaxaq, arguing the mobile food outlet is providing "a service to many workers". Luke Chetcuti has refued to remove the illegal 42sq.m kiosk erected at the corner of Tal-Bar- rani and a narrow lane. Instead he pays a daily €50 fine since last month, when the Planning Authority refused his second at- tempt at regularising the kiosk. He has now once again filed an appeal to the Environment and Planning Review Tribunal against the refusal. But the PA cannot remove the kiosk while an appeal is pend- ing, except for the owner to keep paying dai- ly fines until a final decision is taken. Located just 12m from the Tal-Barrani ar- terial road, Transport Malta has complained that the outlet can cause congestion problems and a lack of visibility for drivers, and lack of safety for clients and pedestrians. While Chetcuti's architect is claiming the kiosk provides "a service to the many work- ers employed in the vicinity", he has rebutted the claim that the kiosk poses a danger, being "well off the arterial road" and that it "provides a more than adequate queuing line without any risk of causing congestion on the main road." Chetcuti expressed his willing- ness to conduct traffic studies to contradict TM's claims. He argued the kiosk is just across the road from a fuel station that offers catering facilities, and can be displaced as required being a converted container vehicle. The kiosk had already accu- mulated daily fines totalling to €3,820 when the PA rejected the application in June 2021. Orig- inally an identical application was rejected in 2020 due to safe- ty concerns raised by TM. Yet the establishment was on- ly slapped by an enforcement order in April 2021, four days after an article published in MaltaToday. But the daily fine has been dated back to the es- tablishment's first attempt to "sanction" the illegal develop- ment in 2020. The application has now been twice refused due to its safe- ty risk. Planning rules prohibit kiosks thta are likely to cause problems of congestion or in- terfere with visibility near road junctions, or where customers have to stand on the carriage- way to be served.
