NEWS 6 maltatoday | WEDNESDAY • 10 NOVEMBER 2021 THE Planning Authority (PA) yesterday reversed a decision that would have restricted public ac- cess to objections presented by the public on different projects. "Objections that are submitted on development applications will remain fully available to the public in the interest of transparency the Planning Authority can confirm," PA said in a statement, hours after a leaked circular revealed the deci- sion to restrict public access. Planning Minister Aaron Farru- gia had disassociated himself from the circular. "The Minister was not informed of this decision by the PA. He strongly believes that the PA should be transparent in its work and has asked the PA for an expla- nation," a spokesperson said. Objections by the general pub- lic were temporarily removed from the PA's public information system making it impossible to quantify the number of people presenting objections to particular projects. Moreover only the archi- tect and the developer would have had access to these objections. The decision was taken on the basis of a General Data Protection Regulation (GDPR) audit which concluded that objections should only be made available to the de- velopers, their architects and PA employees. The PA said in the afternoon that following a GDPR internal audit, it had been advised that representations received through email and conventional mail were potentially in breach of data pro- tection, since personal data was being published and available to the public. Given the fact that the Devel- opment Planning Act does not provide any guidance for the processing or accessibility of rep- resentations, the Authority had opted to follow the guidance as stipulated in the GDPR. "In order to allow further consul- tation on the matter, the Author- ity reversed its decision and will once again keep all representa- tions available to public." "The Authority apologises for any inconvenience this may have caused and remains committed to ensure that the planning process is transparent and open to public access and scrutiny," the state- ment concluded. In the past, the large number of objectors was used by NGOs in their struggle against major devel- opments like the DB towers which attracted thousands of objections. Yesterday's circular had prompt- ed the negative reaction of various NGOs and individuals. Movi- ment Graffitti had described this measure as "a declaration of war" and lawyer and environmentalist Claire Bonello, had described the GDPR audit as a "smokescreen."
