Registry of the Civil Court, Voluntary Jurisdiction Section Today 24th February, 2023 ALEXANDRA DEBATTISTA For the Registrar, Civil Court and Tribunals JAMES DEBONO THE Kamra tal-Periti has welcomed last week's court sentence revoking a permit for a five-storey block in Santa Lucija but warns this could cause "significant aftershocks" to the real estate sector. KTP President Andre Pizzuto described the court decision as a landmark and one that "wipes out the speculative approach to development adopted by the Planning Authority over the past 17 years". In comments to MaltaToday, Pizzuto said the ruling spelt "very positive news" for those keen on sound town planning while adding that it also vin- dicated the chamber's criticism of the interpreta- tion of planning policies in the past two decades. The court decision concerned a proposed five-storey development in Santa Lucija, an area characterised by two-storey houses. Chief Justice Mark Chetcuti revoked the permit that had been confirmed by the Environment and Planning Re- view Tribunal. The court made it clear that the height limitation in the local plan does not result in an automatic right to build up to that height and although a development may adhere to the height limitation in the local plan it could still be in breach of other policies which cannot be overruled simply because the height limitation is respected. But Pizzuto warns the landmark judgment could "have a significant impact on property valuations and the exposure of banks". He advised property owners who have concerns about the impact of the ruling on their financial position, to consult an architect specialised in property valuations. He also announced that after studying the full ramifications of this judgement the Chamber will be holding seminars for archi- tects to keep them abreast of the latest develop- ments. MaltaToday reached out to other stakeholders including environmentalists and activists who welcomed the decision, and the Malta Developers Association, whose president Michael Stivala in- sisted the sentence was nothing new Architects' chief warns of significant impact on property value from landmark court ruling €15 million allocated for electric car grant in 2023 Kamra tal-Periti president Andre Pizzuto NICOLE MEILAK TRANSPORT Malta has launched a €15 million scheme aimed at encouraging the use of cleaner and more sustainable forms of transportation. The initiative, which was launched by Minister for Trans- port, Infrastructure and Capital Projects Aaron Farrugia and Parliamentary Secretary for Eu- ropean Funds Chris Bonett, will support the purchase of new electric vehicles in EU Category L, M and N, including passen- ger cars, vans, goods-carrying vehicles, minibuses, coaches, quadricycles, motorcycles, and pedelecs. The scheme, which is funded by the Recovery and Resilience Plan (RRP), will be available to private individuals, non-gov- ernment organisations, busi- nesses and private companies. The aim is to reduce the num- ber of older conventional mo- tor vehicles on the road and promote the use of more envi- ronmentally sustainable means of transportation. Speaking at the launch, Minis- ter Farrugia explained that this was just one of many schemes that Transport Malta will be launching to promote cleaner vehicles. "Through this scheme, we are continuing to promote the use of cleaner and more environ- mentally sustainable means of transport. This is a direct in- vestment in people, as we are not only offering them financial help to replace their vehicle, but also a direct investment in better air quality," he said. "It is worth reminding that the transport sector is the biggest contributor to air pollution and thus as a government, we will continue to invest in this area." Parliamentary Secretary Chris Bonett added that the scheme would help make the transport sector more sustainable and de- crease emissions caused by pri- vate vehicles. "€50 million are allocated over three years, whereby €15 million were allocated in 2022, a further €15 million will be allocated during this year and the last 20 million by the end of 2024, so that more drivers switch to electric vehicles," he stated. Pierre Montebello, Trans- port Malta's Chief Officer for Land Transport, said that the transport regulator is looking to offer more opportunities to promote better and more envi- ronmentally sustainable trans- port. "We launched this scheme precisely for this reason, and together with other initiatives such as free public transport, TM is ensuring that we have cleaner, more efficient and sustainable transport in our country," he added. Applicants who have pur- chased their vehicle from 1 January 2023 onwards and who meet the scheme's crite- ria, are eligible for this scheme. More information is available on www.transport.gov.mt.
