The General Court of the Eu- ropean Union on Wednesday said that the European Com- mission, the EU's executive arm, had committed an error by excluding Air France and Air France-KLM from the list of po- tential beneficiaries of state aid. KLM is part of carrier group Air France-KLM, whose shares were down more than 4% after the ruling. "It concludes, on that basis, that the Air France-KLM hold- ing and Air France were capable of benefiting, at least indirectly, from the advantage granted by the state aid in question," the court said. Governments scrambled to rescue carriers when travel re- strictions and border closures brought international traffic to a near standstill at the height of the pandemic, with many air- lines receiving billions in state- backed loans. In 2020, the commission ap- proved Dutch state aid of 3.4 billion euros ($3.66 billion) for KLM. The airline in 2022 said it was repaying the final portion of loans it received from the Dutch government and banks, noting that it had borrowed just EUR942 million from the EUR3.4 billion credit facility. The decision marks "another historic win" for Ryanair against state subsidies to European flag carriers, according to Oswell & Vahida, the law firm that rep- resented the airline. Last year, the General Court overturned a similar decision from the com- mission to approve Germany's recapitalization of Deutsche Lufthansa, though the company said at the time that it had al- ready repaid the state. A Ryanair spokesperson said the court's intervention is a "triumph for fair competition" and consumers across the EU, urging the bloc to take steps to repair at least some of the dam- age to competition it said was caused by Dutch state aid. "The EU Commission's spine- less approach to state aid since the beginning of the Covid-19 crisis allowed member states to write open-ended cheques to their inefficient zombie flag carriers in the name of faded national prestige," the spokes- person said. A spokesperson for the com- mission said the body would carefully study Wednesday's ruling and reflect on possible next steps. The decision from the Gener- al Court can be appealed to the EU's highest court, the Europe- an Court of Justice.
