To the Marshall of the Court BY means of a decree given by this Court on the 28th July, 2025, following a request by Ulf Christer Larsson et noe vs deputy cura- tors to represent the respondent or his heirs in the records of the schedule of deposit number 1444/2025 in the names Ulf Christer Larsson et noe vs deputy curators and in the other relative and sub- sequent acts. By means of a schedule of deposit and redemption of ground rent, number 1444/2025 in the names of Ulf Christer Larsson, Swedish passport numbered 96334247, son of Sven and Rut Larsson neè Hansson, born in Malmo, Sweden, on the 15th May, 1949 and residing at 'Dressyrvagen', 6, 246 50 Loddekopinge, Sweeden, represented by his mandatory Peter-Jan Grech (ID 0298280M); and Michael Kissaun (ID 0479857M), divorced, son of Alphonse Maria Gerald Kissaun and Antoinette Cathe- rine Kissaun neè Pecorella, born in Pietà on the 9th July 1958 and residing at 33, La Miradora, Triq G. Despott, Kappara, San Ġwann vs deputy curator to represent the unknown successors in title of Gaudenzio Vella, businessman, unknown identifica- tion number, son of Calzedonio and Giuseppa neè Cachia, filed in the First Hall of the Civil Court on the 14th July, 2025 the ap- plicants Peter-Jan Grech noe and Michael Kissaun respectfully submitted: The applicants together are the owners of: 'the perpetual domestic utile of a divisible portion of land forming part of the field known as "Tal-Twiela" sive "Ta' Tal- iana" in the vicinity of Kappara limits of St Julian's, measuring superficially one hundred and eighty square canes (180 sq.c) in- cluding part of a private road half of the projected new road's width, garden and building site bounded on the south by the private road, on the east by the projected new road and on the west by the rest of the same land subject to the rate of annual and perpetual groundrent of forty five liri (£45), better delineat- ed in the attached plan marked with the letter "A"..." A site plan is being attached indicating the land in question with the colour red which is being marked as "Doc A" and this in terms of Article 1501 of Cap. 16 of the Laws of Malta. The land was originally acquired from Paolo Grixti, Robert Eminyan and Gustav Ricci from Gaudenzio Vella as part of a larger land and this by means of a contract in the records of Notary George Bonello du Puis dated 10th August, 1961 (copy of this deed hereby attached and marked as Doc B). The over- all land of Gaudenzio Vella in that deed (measuring 730 square canes) was subject to an annual and perpetual ground rent in the amount of one hundred and eighty one liri (LM181). This land was subsequently acquired by Alphonse Maria Kissaun during his marriage with Antoinette Catherine Kissaun nee 'Pecorella, by onerous title from Paolo Grixti, Robert Em- inyan and Gustav Ricci, by virtue of a contract published in the records of Notary George Bonello du Puis of the 6th October, 1962 and subject to an annual and perpetual groundrent pro- portionate to the size of 180 square canes, of forty five Mal- tese Liri (LM 45), equivalent to one hundred and four Euro and eighty five cents (€104.85). (copy of this deed hereby attached and marked as Doc. C) Alphonse Maria Gerald Kissaun died on the 26th October ,1996, and by virtue of his will published in the records of No- tary Clyde La Rosa of the 8th June, 1988, he bequeathed the use and usufruct of his patrimony in favour of his wife, Antoinette Catherine Kissaun, and nominated his two (2) children as heirs, namely Sylvia Larsson neè Kissaun and Michael Kissaun. His part in the property in question was declared in a decla- ration causa mortis published in the records of Notary Peter Fleri-Soler of the 16th April, 1997 (copy of the note of registra- tion of this act hereby attached and marked as Doc. D). The wife of Alphonse Maria Gerald Kissaun, or rather Antoi- nette Catherine Kissaun neè Pecorella, died on the 14th June, 2000, and by virtue of her will published in the records of Notary Clyde La Rosa of the 8th June, 1988, she revoked and annulled all the wills prior, bequeathing the use and usufruct in favour of her deceased husband and nominated her children, or rath- er Sylvia Larsson neè Kissaun and Michael Kissaun, as her sole universal heir. Her relative share in the property in question was declared by means of a declaration causa mortis published in the records of Notary Peter Fleri-Soler of the 1st November, 2000 (copy of this deed hereby attached and marked as Doc .E). Sylvia Larsson neè Kissaun died intestate in Malta on 11 April, 2017, and by virtue of her last will of Sweden of 19 October, 2010, she nominated her husband, Ulf Larsson, as her sole uni- versal heir. Her relative share in the property in question was declared by means of a declaration causa mortis published in the records of Notary Louisa Vella Bardon of the 22nd February, 2018 (copy of this deed hereby attached and marked as Doc. F). Consequently, and as already stated, the applicants today are the only two owners of the property in question. By means of this schedule of deposit, the applicants wish in the first place and in order to exonerate themselves from all respon- sibility, to deposit the groundrent for the last five years. Thus the applicants are depositing the sum of five hundred twenty four Euro and twenty five cents (€524.25) representing the an- nual and perpetual groundrent in the amount of forty five Mal- tese Liri (LM45), equivalent to one hundred and four Euro and eighty five cents (€104.85), of the last five years. In the second place, the applicants wish to avail themselves of the option given to them in Article 1501 of Cap. 16 of the Laws of Malta and redeem the groundrent in the amount of for- ty five Maltese Liri (LM45), equivalent to one hundred and four Euros and eighty five cents (€104.85) which was constituted as explained above. The groundrent on this portion of land is to be redeemed by capitalising the sum due of the groundrent at the rate of five per cent. Thus the amount of one hundred and four Euro and eighty five cents (€104.85) due as groundrent to the respondents above mentioned capitalised at the rate of five per cent amounts to the total of two thousand ninety seven Euro (€2,097). Thus the applicants are humbly calling upon this Honoura- ble Court and under its authority are depositing the sum of two thousand six hundred twenty one Euro and twenty five cents (€2,621.25), which sum represents (i) the arrears of groundrent of the last five years (ii) as well as redemption of this annual and perpetual groundrent, and this so that this sum be withdrawn by whoever has the right to it according to law after leaving the duly receipt according to law. Deputy Curators You are therefore ordered to affix an official copy of these banns at the entrance of this Superior Court and to summon whosoever wishes to act as curator to appear before this registry within six days and by means of a minute to submit a declaration that he wishes so to act. You are also ordered to inform each one that if he fails to make this declaration within the stipulated time, the Court will pro- ceed to the selection of Curators of Office. And after so acting or if you should encounter any difficulty in the execution of these banns, you are to inform forthwith this Court.
