Today 20th February, 2026 Registry of the Superior Courts, today 6th March, 2026 ALEXANDRA DEBATTISTA For the Registrar, Civil Courts and Tribunals 174 apartment blocks over nine floors recommended for approval in Msida A large residential complex comprising of 174 apartments spread over nine floors has been recommended for approval by the Planning Authority's case officer in a densely built part of Msida instead of an area hous- ing disused warehouse. The proposed development at Triq it-Torri and Trejqa ta' Boxbox would include 174 apartments, three small retail outlets and around 250 un- derground garages within a site measuring roughly 4,150 square metres. The project proposed by Ex- cel Investments Limited – a company owned by Mark Agi- us, Joseph Portelli and Daniel Refalo forms the second phase of a redevelopment that already obtained permission for demo- lition and excavation works in 2025. The area is currently occupied by warehouses and is situated between Trejqa ta' Boxbox and Triq it-Torri, uphill from Val- ley Road and close to regional road. According to its propo- nents the development will im- prove the urban quality in the area due to the inconvenience caused by the disused ware- houses due to trucks which used to transport goods from and to the warehouses. According to the case officer's report, the development will include two underground park- ing levels and a further parking level partly integrated with residential units. In total, the scheme will provide 250 lock- up garages, significantly ex- ceeding the 174 parking spaces required by planning policy for the number of apartments pro- posed. The residential component will be spread across seven main levels plus two receded top floors, with most floors accommodating around 25 to 27 apartments. The scheme includes a mix of 20 one-bed- room units, 128 two-bedroom apartments and 26 three-bed- room units, 15 of which are penthouse-style units located on the receded top floor and set back from the building façade. At street level, the develop- ment will also include three Class 4B shops with floor areas ranging from 24 to 59 square metres, intended to serve the surrounding residential neigh- bourhood. Despite the scale of the devel- opment, the case officer con- cluded that the proposal com- plies with height limitations in the area. The sloping of the site and streets was taken into ac- count to determine the height of the new block. The case of- ficer cited a policy which al- lows the building envelope to be projected upwards along the gradient, meaning the height limit can be applied from the highest street level, effectively permitting the nine floors pro- posed without exceeding the maximum building height on both Triq ta Box Box and Triq it-Torri. The site lies next to a row of townhouses that are scheduled at Grade 2 for their cultural heritage value, raising concerns from the Superintendence of Cultural Heritage about the impact of the new development on their setting. The Superin- tendence initially warned that the project risked negatively affecting the historic streets- cape and called for mitigation measures, including increased setbacks and terracing near the scheduled buildings. It recommended a minimum three-meter setback and ter- racing to protect the heritage context. Following revised plans, the authority acknowl- edged improvements to the design, noting that the updat- ed scheme provides more open space around the protected properties, whose context has already been affected by other tall buildings nearby. An updated Traffic Impact Assessment found that the roads can handle the extra vehicles, and existing right- of-way access for neighbours is preserved. Both Transport Malta and the transport con- sultant agreed, concluding that the development's traffic im- pact is acceptable and manage- able. The case officer concluded that the development is ac- ceptable in principle within the residential area and recom- mended that the Planning Au- thority grant permission sub- ject to several conditions. The final decision on the applica- tion is expected to be taken by the Planning Authority board on 9 April 2026.
