MATTHEW AGIUS A Marsascala hotel has filed judicial proceedings against Turkish construction company TACA over an unpaid €250,000 bill for lodging and food that it provided for its workers. TACA is one of a number of international construction companies that submitted a bid for the redevelopment of the Fortina Hotel in Sliema and the DB Group's City Centre pro- ject on the former ITS site in St Julian's. Earlier last year, the company hit the headlines for allegedly accommodating their Turkish workers in prefabricated build- ings constructed in a repur- posed quarry. Since then, they moved their workforce accom- modation to the Cerviola Hotel in Marsascala. Last month MaltaToday re- ported that a group of 80 Turk- ish workers had not been paid by TACA for over five months. A few weeks after reportedly failing to pay its workers, TA- CA was hit with a lawsuit by Cerviola Hotel Limited after allegedly also failing to pay for food and accommodation. In a sworn application be- fore the First Hall of the Civil Court, Cerviola's Managing Director Alexio Borg, claimed that after failing to settle some 22 unpaid invoices, TACA In- saat Ve Ticaret A.S. was a debt- or to Cerviola to the tune of €250,289 besides legal interest. The sum represented lodging, food, transport and related ser- vices provided by the hotel. Borg said that Cerviola had sent a statement of dues to TA- CA which the Turkish com- pany had accepted and agreed was due. But TACA had failed to settle the bill, despite several requests for payment being sent to it. TACA had explained that it had found itself in difficulties with its clients, Borg said. "I had made several requests for payment of the amounts due, even through a lawyer, but despite TACA not contesting this sum as being due, it did not pay," Borg's sworn declaration reads. Claiming the debt is certain, liquid and due, and that there was no defence to the action, the plaintiff asked the court to decide the case summarily. Lawyers Pawlu Lia and Phyllis Aquilina signed the application. magius@mediatoday.com.mt 13 maltatoday | SUNDAY • 19 JULY 2020 NEWS COURT NOTICE The Registrar, Civil Courts and Tribunals notifies that the First Hall of the Civil Court ordered the sale by Judicial Auction of the following property to be held in room numbered 78, nearby the Courts Archives, Level -1, Courts of Justice, Republic Street, Valletta. States' human rights obligations should not be obliterated in times of cri- sis. "Yet Malta's government has made no attempt to ad- dress and reform the coun- try's draconian abortion laws, or in any way facili- tate access to abortion care abroad during this pandem- ic. Instead, pregnant people are criminalised for access- ing care that should be pro- vided locally… "We cannot wait for the pandemic to be over before focusing on SRHR. Abor- tion is time-sensitive, es- sential healthcare, and must be prioritised during COV- ID-19. We should not wait for a tragedy before enacting change." Malta remains the only EU and Commonwealth coun- try with a total legal ban on abortion, despite its progres- sive steps to legislate divorce and introduce emergency contraception and same-sex marriage. Both main politi- cal parties have publicly af- firmed their opposition to abortion. Estimates suggest that over 500 women in Malta access abortions each year, many travelling to countries ac- cording to their financial means and mobility. The other safe, though illegal way to access abortion from Malta is through the online purchase of medical abortion pills mifepristone and miso- prostol, from reputable or- ganisations such as Women Help Women and Women on Web. But the establishment of a pro-choice movement in 2019, together with pro- choice medical profession- als, led to an increase in abortion talk in the public sphere. "Despite this shift in public discourse, abortion remains highly stigmatised in Malta's pro-natalist society," Caru- ana-Finkel wrote. "Misin- formation is spread through various channels: social me- dia, traditional media, school education, and religious in- stitutions. Criminalisation has led to a chilling effect in those seeking abortions and in healthcare professionals." Caruana-Finkel also said that due to the fear of po- tential legal repercussions, women may delay seeking medical attention in ra- re events of post-abortion complications, while many healthcare professionals in Malta are reluctant to pro- vide information about abor- tion, even though it is legal to do so. "Most abortion experiences remain shrouded in secrecy and silence," Caruana-Finkel said, adding that having to travel abroad for healthcare is "inhumane" and discrim- inates against individuals who are unable to do so. Abortion Support Network is now providing financial as- sistance to Maltese residents, but there are other barriers. "A pregnant teenager, a sin- gle mother without access to childcare, a woman living with an abusive partner, an individual with disability, and an asylum seeker lack- ing travel documentation all face additional obstacles. Unfortunately, there are also anti-abortion organisations targeting women with mis- information and deception to prevent abortion access," Caruana-Finkel said. Liza Caruana-Finkel "Another woman was unable to purchase her usual contraception and was raped by her abusive partner, which resulted in an unwanted pregnancy."
