The funds were handed to him by the client to settle taxes after they bought two garages. Pierre Falzon, 64, was con- victed of misappropriating €850 from a couple who had paid him stamp duty and capital gains when buying two garages in Swieqi in 2010. Despite the cou- ple paying all expenses, Falzon had failed to register the proper- ty transfer or forward any taxes to the authorities. These funds which were depos- ited into his wife's account and were never returned until after police intervention. Magistrate Rachel Montebel- lo sentenced Falzon to one year in prison, suspended for three years and ordered him to repay his clients €850. Moreover, the court also disqualified him from holding a notarial warrant. However, Falzon was acquitted of several other misappropria- tion charges after the court rules that whilst he was negligent and breached conditions of his pro- fessional obligations, the evi- dence did not prove beyond rea- sonable doubt that what he did was with malicious intention. The prosecution brought for- ward multiple arguments, dat- ing back to 2009 to 2011. These involved unregistered property transfers, unpaid taxes, and de- lays that left clients unable to register inherited property in their names. In another instance, a buyer claimed to have paid €425 in stamp duty for a garage in Birkir- kara, but the court noted there was no proof the money had ac- tually been given to Falzon. The court also heard that Falzon spent about a year abroad during the period in question, and on returning, settled some of the outstanding tax pay- ments. His defence argued that the delays were partly caused by court-imposed garnishee and attachment orders that froze his accounts, as well as his wife's ill health. While acknowledging his pro- fessional negligence, the court found that the only proven case of misappropriation involved the Swieqi couple, whose money was deposited in his wife's bank account and never transferred to the tax authorities. Magistrate Montebello also criticised the way the proceed- ings were conducted against Falzon, describing it as a "classic case" of poor administration of justice. CONTINUES FROM PAGE 1 In the night between Mon- day and Tuesday, a number of localities across Malta and Gozo recorded power cuts, with many having electricity restored after a couple of min- utes. Parts of Tarxien were worst affected, with some are- as left three hours without any electricity. Enemalta Executive Chair- man Ryan Fava, explained that, compared to last year, electricity demand peaked earlier, as a similar demand was recorded in 2024 on 19 July. "While this increase is note- worthy and a reflection of how the earlier rise in temperature is affecting demand, Enemalta has the necessary generation capacity to meet its custom- ers' demand," he said. A spokesperson also said on- going investments in the dis- tribution network are enhanc- ing Enemalta's capacity to address situations where high voltage levels cause faults. "Enemalta is thus better po- sitioned to restore power to areas benefiting from these infrastructural improve- ments. Notably, with the commissioning of over 140km of new underground cables in the past two years, Enemalta has efficiently restored sup- ply to customers impacted by faults, owing to the increased flexibility and resilience of the distribution system resulting from these developments," a spokesperson said. The spokesperson also said teams across all departments have been working hard to prepare for the ever-increas- ing temperatures, and Ene- malta are in a far better po- sition to switch clients on to alternative sources in cases of faults. "In the instances where such flexibility is not yet availa- ble, Enemalta resorts to al- ternative sources to alleviate the situation until the fault is identified and fixed," Fava said.
