Good, but that is not enough. Your trademark should not just be in- novative and recognisable but also reg- istered. Consumers can recognise the product or service that you offer through your trademark, and immediately associate it with your company or enterprise. Thus, your product or service will be easily distinguishable from products and ser- vices that are similar or in the same line of business. By registering your trademark you can reap various benefits. First, your trade- mark, provided that this is innovative and distinguishable, will not be vulner- able, as you will enjoy exclusive rights to the name or logo, whose reputation you will have built after so much time and effort. But there are further advantages. A trademark that is easily recognisable can attract a greater number of consum- ers to your product or service. Besides, a clearly recognisable and reputable trademark can be licensed, transferred, as well as form part of the assets of an enterprise. A strong registered trade- mark can be an effective tool to prevent third parties from taking advantage of the reputation you will have built by us- ing a trademark that is similar or identi- cal to yours. A robust trademark can open up new paths and new markets for your service or product both locally and abroad. You can market your brand abroad by reg- istering a European Union Trademark (EUTM) at EU level. The EUTM system coexists with and is complimentary to the national trademark registration. A prospective EUTM applicant will only be required to file one application. When registered, it will give the owner the exclusive right in all 28 EU coun- tries. This can open up a vast range of opportunities for your business to grow and gain recognition abroad. If you intend to register an EUTM, you should keep in mind whether the regis- tered trademark in Malta can work the same way abroad. You will appreciate that you may have to adapt your trade- mark and modify your marketing strat- egy to fit the needs of your customers abroad. Protecting your trademark is a neces- sity. Trademark registration could be one of the factors that help your busi- ness be successful, as it allows you to build a strong recognisable trademark and prevent it from being used illegally by someone else. For further information on how to protect and register your trademark in Malta, visit the Industrial Property Reg- istrations Directorate (IPRD) section on the Commerce Department website at www.commerce.gov.mt or phone Busi- ness First on 144. Should you be interested in protecting and registering your trademark in the European Union, kindly visit the Euro- pean Union Intellectual Property Office (EUIPO) at www.euipo.europa.eu. Registering your trademark is a necessity
