The property three hundred and ten (€310,000). 19th July 2018 11.30am Apartment on the fourth floor overlying four floors of third JAMES DEBONO THE discount supermarket Lidl is earmarking the existing SMW Cortis building in Zebbug for dem- olition, for the construction of a new supermarket and underlying commercial development on the corner between Mdina Road and Attard Road. Plans foresee a basement and surface parking and underlying commercial and industrial devel- opment. The location is partly zoned as an 'area of con- tainment' – an area meant to contain industrial developments located outside development zones (ODZ), meant to avoid their sprawl in the surrounding countryside. But the proposed development will extend into the surrounding ODZ to create parking spaces and provide road access for the new supermarket. A permit issued in 2014 had specified that the new premises be only used for "storage and dis- tribution purposes", limiting a proposed retail shop to 58sq.m on ground floor level. A scheduled windmill is located on the south- ern periphery of the site and is surrounded on three sides by the applicant's property. A surface carpark accessed from Attard Road will be devel- oped in the area behind the windmill. Lidl has already opened two ODZ stores in Luqa and Safi, both approved before the 2008 general elections. Other Lidl stores are situated in Sta Venera, San Gwann, Zejtun, and Qormi, and in Xewkija, a small part of which is also out- side the development zones. Another supermarket was approved instead of the Fort Blocks industrial complex in Mosta. Lidl has recently applied to change local plans in Fgura to allow the approval of a supermarket on a former scrap yard zoned for a mix of recrea- tional, residential and retail facilities. An application to build a Lidl outlet on ODZ land by the bypass between San Gwann and Birkirkara has been withdrawn. Current PA policies regulating retail develop- ment encourage the location of such develop- ments in town centres to decrease the impact on traffic. But this policy has been largely disre- garded. Lidl wants to open supermarket in Zebbug JAMES DEBONO MALTA still lacks a na- tional register of approved consultants who carry out environmental impact as- sessments, 20 years since EIAs became a requirement for major developments. It means the island has no entity that can take legal or regulatory action against consultants who present flawed reports and mislead the Environment and Re- sources Authority or the Planning Authority in their decisions on big projects. The Environment Protec- tion Act states that a regis- tration board composed of a maximum of five mem- bers should be appointed by the minister responsi- ble for the environment. The task of this board is to evaluate requests by EIA consultants for inclusion in a national register which would make them eligible to carry out EIAs, audits, monitoring and studies as required by the ERA. A spokesperson for the ERA said that a registra- tion board required by law to evaluate applications for inclusion in a register of consultants has not been appointed. EIAs are carried out by environmental consultancy companies who are paid directly by the developer. The consultancy firm then hires experts on the specific issues identified in 'terms of reference' issued by the ERA, normally including studies on biodiversity, vis- ual, geological and air qual- ity impacts. A final report is com- piled and submitted to the ERA, which issues a recom- mendation to the Planning Authority based on the re- ports. The registration board en- visioned by the law would have the power to revise the register and remove consultants in cases where they submit "sub-standard or deliberately misleading work in an environmental assessment." Other reasons for re- moval from the register include being found guilty by a court of law of a crime committed through fraud, corruption, false declara- tion, or for not paying an- nual renewal fee. Anyone participating in a consult- ant's role in an EIA with- out being registered would then be barred from regis- tering or participating in any EIAs for a minimum three-year period. Draft guidelines for the registration of EIA con- sultants had been issued in 2009 by then environment minister Mario De Marco, as part of the Malta Envi- ronment Planning Author- ity reform proposals. An EIA "registration and re- view board", chaired by sci- entist Kevin Gatt, was also appointed but the register of consultants never mate- rialised. jdebono@mediatoday.com.mt Environment Impact Assessments still unregulated after 20 years
