NEWS 8 maltatoday | WEDNESDAY • 21 AUGUST 2019 JAMES DEBONO A permit for a petrol station opposite the Marsaskala Fam- ily Park may be revoked by the Planning Authority's board, after an objector provided evidence that the site notice announcing the application in 2010 was not affixed on the site earmarked for the fuel station – but on the other side of the road. The permit for the 1,500sq.m fuel station, proposed by Patrick Guntrip, was issued in Decem- ber 2017 with only the Environ- ment and Resources Author- ity chairman Victor Axiak and NGO representative Annick Bonello voting against. The site, a tract of land outside develop- ment zones, has already been excavated. But in January 2019, lawyer Nathalino Caruana De Brincat, writing on behalf of the owners of a villa located near the fuel sta- tion, presented a request for the revocation of the permit because photos on the Planning Author- ity's website clearly show that the site notice was affixed to the Wasteserv site across the road, and not on the site earmarked for the petrol station, which is closed by a rubble wall. The objectors claim that they did not object to the application, describing the way the site notice was attached as "a Machiavellian tactic to deviate the attention of potential objectors." The request for the permit's revocation was reviewed by the PA's planning directorate, which concluded that "there is ample proof that the site notice was not affixed correctly" and this had "a material bearing on the decision" and therefore there is a basis to initiate procedures in line with Article 80 of the Development Planning Act 2016. For this reason, it will be the PA board that will meet on 19 September which will discuss whether the permit can be re- voked or not. As a rule, the basis on which a permit may be revoked or modi- fied, are 'fraud', 'the submission of any information, declaration or plan which is incorrect or does not reflect the situation on site' and 'where there is an error on the face of the record'. Permits previously revoked by the PA board included that for the development of villas instead of Ulysses Lodge in Ramla l- Hamra in Gozo and a permit for a disco at Mistra on land owned by Jeffrey Pullicino Orlando. Applicant Patrick Guntrip is the husband of Josephine Gun- trip, a shareholder in a Schem- bri Barbros subsidiary, Seaview Construction, which donated €20,000 to Labour through its subsidiary Seaview & Sons. Seav- iew is in the main owned by the Schembri family, of the Schem- bri Barbros construction group. Seaview & Sons also runs the Pit Stop fuel station in Attard, amongst others. The Schembri Barbros group is also seeking a permit to develop a shopping mall on the site of a dis- used quarry on Triq Sant Antnin, Marsaskala, near the site for the proposed fuel station.
